|Be it known that whereas Micajah Bullock the elder late of the County of Granville and the State of North Carolina, departed this life on the 30th of April last or thereabout. That Edward Bullock one of the children and heirs at Law of the said Micajah, at the May Term last of the Court of Pleas and Quarter Sessions presented to Court a paper writing, purporting to be the last Will and testament of the Said Micajah decd. wherein the said Edward & Leonard Henderson and Susanna Bullock appeared to be appointed Executors and Executrix; Whereupon Benj. Bullock for himself & for Nancy Dolby both being children and heirs at Law of sd. Micajah entered a caveat, and an issue of devisavil vel non, was then made and is now pending for trial. Whereas Edward Bullock, Benjamin Bullock, Nancy Dolby, Leonard Bullock & Fanny Fleming the wife of Wm. Fleming, the children and only children and heirs at Law of the Said Micajah deceased, have agreed upon terms of compromise to wit, to let the said paper writing be proved as the last Will and testament of the said Micajah, and for the provisions of said Will to Stand & be carried into effect according to the true intent and meaning of the same, with this exception, to wit, that Nancy Dolby is to have an equal Share with her brothers and Sisters of all the personal estate of the said Micajah; and also an equal Share in like manner of all the real estate of which the said Micajah died Seized and possessed except the home tract upon which the said Micajah lived next before his death, and the tracts adjoining said tract. Now to that end, we Edward Bullock, Benjamin Bullock, Leonard Bullock and William Fleming have covenanted and agreed and by these presents do covenant and agree to and with Nancy Dolby of the State of Tennessee his heirs, Executors & administrators to set off and allot to her one fifth part of the personal estate of and to which the said Micajah died possessed & entitled; as soon as the same can be set off and allotted to him according to the provisions of the will; and also one fifth part of all the lands and tenements of which the said Micajah died seized and possessed, except the home tract and the tracts of Land thereunto adjoining. To have and to hold the same as his separate property to her heirs, Exrs., Admrs., & assigns forever -- to effectuation of which according to the true intent and meaning of this agreement, We Ed. Bullock, Benjamin Bullock, Leonard Bullock and Wm. Fleming for ourselves, our heirs, Exrs. & Admrs. covenant and agree to and with the said Nancy Dolby, her heirs, Exrs., admrs., and assigns forever. In Testimony whereof we have hereunto set our hands & seals, this the 8th day of August A.D. 1828.
