This Indenture made ye fifth day of march in ye year of our Lord God one Thousand six hundred seventy & nine Between Susannah Davis & Elizabeth Brookes of Rappahanock in Virg'a of ye one part, and Thomas Wootten of ye Poquoson parish in the County of Yorke of ye other part

Witnesseth That ye sd. Susannah Davis & Eliz'th Brookes for themselves their heirs Ex'rs Adm'rs Doth demise Lease and to farme Lett A plantaton Which doth belong to them ye sd. Davis & Brookes Situate & lying upon Chismans Creek in Yorke Prsh, To the said Thomas Wootten his heirs Ex'rs Adm'rs or Assignes, To have & hold all & singular the above Demised Premisses with ye housing Orchard & farming and with all other apptences thereunto belonging, ye Which plantaton Containeth One hundred Acres of Land, the Which plantaton the sd. Susannah Davis & Eliz'th Brookes for themselves their heirs Ex'rs Adm'rs Doth Lett unto ye sd. Thomas Wootten his heirs Ex'rs Adm'rs or assignes for ye full end & Term of ninety & Nine Years fully to be Compleat & ended, the Consideration of five Thousand pounds of Tobacco being in hand Received by us ye Said Susannah Davis & Elizabeth brookes,

Therefore We the said Susannah Davis & Eliz'th Brookes for Our selves Our heirs Ex'rs Adm'rs doth Covenant promise & grant to & with ye sd. Thomas Wootten his heirs Ex'rs Admr's or Assignes, That he the said Thomas Wootten his heirs Ex'rs Adm'rs or Assignes Yeilding & paying yearly and every year the quitt rents of ye Said Land, When they Shall be demanded, that then it shall & may be Lawfull to & for the said Thomas Wootten his heirs Ex'rs Adm'rs or Assignes to use possess & enjoy the Above demised premisses, Without ye Lett sute or Deniall of them ye sd. Susannah Davis and Eliz'th Brookes their heirs Ex'rs Adm'rs or any other pson or psons that hereafter may or shall from them or by them that shall lay Claime thereunto,

furthermore Wee ye Sd. Susannah Davis & Eliz'th Brookes for our Selves our heirs Ex'rs Adm'rs doth Covenant promise & grant to & with the said Thomas Wootten his heirs Ex'rs Adm'rs & Assignes, That at ye Expiration of this Above mentioned Term of time of ninety & nine years be fully Compleated & ended May & shall have the above Demised premisses, for ye Next Ensuing Ninety & nine years following the above mentioned Term of Time, Yielding and paying therefore yearly & every year during the whole term of ninety & nine years, The quitt rents of ye Above Demised Land, and one grain of good Sound Indian corn, the sd. quitt rents to be paid to them yt shall demand them, and ye sd. grain of Corn to be paid to ye Sd. Susannah Davis & Eliz'th Brookes their heirs Ex'rs Adm'rs to be paid yearly & every year from ye begining to ye Expiration of ye Second Term of time if Lawfully demanded by them their heirs Ex'rs Adm'rs or any pson or psons from them or by them that may hereafter have Right or Interest thereunto.

But if it shall happen yt ye said Thomas Wootten doth not Well & truly Observe form fulfill pay & keep all & Singular the Covenants & Agreem'ts hereafter & by these presents mentioned, That then it may & shall be Lawfull to & for ye Sd. Susannah Davis & Eliz'th Brookes their heirs Ex'rs Adm'rs into all & Singuler, to Re-enter & Re-possess and Enjoy again, as their first & former Estate, and the said Thomas Wootten his heirs Ex'rs Adm'rs or Assignes utterly to Expell & Amove from any part of this Indenture Notwithstanding,

And Lastly If ye said Thomas Wootten for himself his heirs Ex'rs Adm'rs or Assignes doth Well and truly Observe, fulfill, pay & keep all and singular the Aforenamed Covenants and Agreem'ts That it shall & may be Lawfull To & for ye Sd. Thomas Wootten his heirs Ex'rs Adm'rs or Assignes to possess & Enjoy the above demised premisses Without ye Lett, Suitt or deniall of them the Sd. Susannah Davis and Eliz'th Brookes their heirs Ex'rs or Adm'rs or any Other pson or psons that may or shall hereafter lay any claime or Interest thereunto.

proved in Court by ye oath of Mr. Henry Hayward one of ye Witnesses to ye Within Lease, and it Recorded

Know all men by these presents yt We Susannah Davis & Elizabeth Brookes of the County of Rappahanock in Virg'a doth acknowledge to stand Indebted unto Thomas Wootten of Yorke County his heirs Ex'rs Adm'rs or Assignes the full & Just Sume of Ten Thousand pounds of Every Way good Sound & well conditoned Sweet sented Tobacco & Case to Contain ye Same to be paid upon demand Convenient upon ye new poquoson River, to ye with paymt. We gind our selves our heirs Ex'rs Adm'rs firmly by these presents Sealed with my seale Dated ye 5th day of March 1679.

The Condition of this obligation is Such that if ye above bounded Susannah Davis & Elizabeth Brookes that she ye said Eliz'th Brookes shall & will confirm her Bargaine with me ye sd. Thomas Wootten his heirs Ex'rs Adm'rs or Assignes when she ye sd. Eliz'th Brookes shall come to her full age So yt ye Sd. Thomas Wootten come to no charge nor damage, That when this Obligaton to be voyd & of none Effect or Otherwise to stand in full force & vertue.  As Witness our hands this 5th day of March 1680.
