In the Name of God Amen the twenty Second Day of May one thousand Seven Hundred and twenty Eight year. I Thomas Elsbery of Queen Anne County in ye province of Maryland Planter being very Sick and weak in body but of perfect mind & memory thanks be given unto god therefore calling unto mind the mortality of my body and knowing that it is appointed for all men Once to die do make & ordaine this my last will & testament yt. is to Say principally and first of all I give and recommend my Soul into the hands of god that gave it and for my body I recommend it to the Earth to be Buried in a Christian like and decent manner at ye descretion of my Exr. nothing doubting but at the Generall Resurrection I shall reenter the same Again by the mighty power of God and as touching such worldly Estate wherewith it hath pleased God to bless me in this life; I give devise and dispose of ye same in the following manner and form.

Imprimis I give and bequeath unto Margaret Elsbery my dearly beloved wife the Plantation I now live upon Containing one hundred acres of land dureing her Life and to Henry Burt her Son after her decease unless the said Margaret should come to want she may have the Liberty to Sell it likewise I give and bequeath all my personal Estate Cattle Hoggs Horses and all out Sight and in Sight that belong to me and I do hereby utterly disallow revoak and disannull all and Every other former testament, will, Legacies, and Exr. by me in any ways before this time named willed and bequeathed ratifying & Confirming this and no Other to be my last will & Testament in wittness whereof I have Set my hand and Seal the day & year above written.

On the Book of ye aforegoing will was there written viz:
 May ye 7th 1728 Then Came Patrick Robertson and William Hadden the Subscribing wittnesses to ye within will and made Oath on the holy Evangels of Almighty God that they did See the testator Thomas Elsbery Sign and Seal the within Will and heard him publish & declare the same as his last Will & testament and that at the time of his so doing that he was to ye Best of their knowledge and apprehension of sound and disposing mind and memory and that they ye aforesd. Patrick Robertson & Wm. Hadden as wittnesses subscribed the within will in Presence of the within Testator.
