The State of Texas County of Cass } This indenture made and entered into this the 7th February AD 1861 Eighteen Hundred and Sixty one between Mary Mitchell of the County of Cass & State of Texas of the first part and Charls Graham of the County and State aforesaid of the second part. Witnesseth that, I Mary Mitchell for and in consideration of the sum of one thousand Dollars to me in hand paid by the said Charls Graham, a certain tract or parcel of Land described as follows to wit: Lying in Red River County and in the State of Texas, on Pine Creek it being a part of Elisha Simmons Head Right and located on what is known as the lower Pine Bluffs tract and bounded as follows, Beginning at the South West Corner of a six Hundred and forty acres sold by R C Graham to two of the Mrs. Laboons.  Running south with the West line of sd. 640 acres, 1344 Vs. to a stake. Thence West South and East to the beginning so as to make three Hundred and twenty acres. to have and to hold the aforesaid land with all and singular the appertenances hereditament and benefits thereunto belonging unto the said Charls Graham his Heirs and assigns forever all their right title Claim and interest in and to the same and I the said Mary Mitchell doth warrant and defend the same from my self my Heirs and assigns and all other persons lawfully claiming the same unto the sd. Charls Graham his heirs & assigns The title to the above described land. In testimony Whereof I Have hereunto set my hand using scroll for seal this the day & date before writen.  Signed sealed and delived in the Presents of the subscribing witnesses.        Mary her X mark Mitchell (seal) atest Hez Horner J M Wood The State of Texas County of Cass } Personally appeared before the undersigned authority J M Wood with whom I am personaly acquainted & whose name appears as one of the subscribing witnesses to the annexed & foregoing deed of conveyance from Mary Mitchell to Charles Graham who being duly sworn says on his oath that he saw the said Mary sign seal and deliver the same and acknowledge it to be her act & deed for all the considerations uses & purposes therein contained and expressed.  (LS)  Witness my hand and seal of office at office in Linden this 8th day of Febuary 1861        Thos J White Clk C.C.C.C.
