Book L Pages 228-9-30-1-2-3 Deed of Trust Samuel A McKenzie to Wm H Cannon for the use of G Cannon No. 106.
This indenture made and entered into this 23rd day of March 1840. by and between Saml A McKenzie of the first part and Wm H Cannon of the second part and Builford Cannon of the third part all of the county of Monroe and State of Tennessee Witnesseth that whereas the said Samuel A McKenzie Stands indebted to the said Guilford Cannon in the sum of two hundred and fifty dollars and forty six cents which hath this day fall due and the said Cannon being to wait untill the first day of October next by having his debt and interest secured and the said McKenzie having executed his promissory note unto the said Cannon for said of two hundred and fifty dollars and forty six cents due the first day of October aforesaid bearing interest from this date and whereas also the said Guilford Cannon hath bound himself as endorser for the said McKenzie to the amount of two hundred and sixty four dollars in the Branch Bank of Tennessee at Athens which is intended to be ------ so as to fall due the first day of October next and the said Samuel A McKenzie being willing and desirous to Secure him the said Cannon and give him a certain assurance that his money shall be paid by said first day of October aforesaid as also to indemnify him from all liability as endorser as aforesaid to the payment of said two hundred and Sixty four dollars to the Bank aforesaid the Said Samuel A McKenzie as well in consideration of securing the said Guilford Cannon in the faithful payment of the debt & interest aforesaid and the mor effectually to secure him said Cannon from the payment of the said debt to the Bank aforesaid as also the sum of One dollar in hand paid by the said Wm H Cannon to him the said Samuel A McKenzie the receipt whereof is hereby acknowledged the said Samuel A McKenzie hath bargained Sold transfered and assigned and Set over and by these presents do bargain sell transfer assign and Set over unto the said William Cannon his heirs &c

the following property viz fourteen bed Steads with twelve feather beds and under beds including all the clothing and furniture thereunto appertaining one fine Side board one Safe two large Cherry Bureaus and one Small Bureau one press top eight large and Small Tables Sixteen Windsor Chairs twenty Split bottomed Chairs one Clock one Writing desk one small Book case together with all the Books therein one large Map of the United States twelve pictures and frames six looking glasses ten Window Curtains three small trunks one Candle Stand eight brass Candle Sticks six Linpool Euston & delph pitchers two dozen cups and saucers three dozen plates two dozen knives and forks two chests one dark colored milk cow and yearling one Brown mare pony

to have and to hold all said property as belonging to him the said William Cannon his heirs &c. for the purpose herein after mentioned and for no Other use or purpose whatsoever viz that in case the said McKenzie shall fail to pay to said Cannon the said debt of two hundred and fifty dollars and forty six cents with interest and also fail to pay and Satisfy the said Debt in Bank or any part by Said first day of October next or portion thereof that then it shall and may be lawful for the said William H Cannon and he is hereby authorised and requested by giving ten days written notice at three of the most public places in the neighborhood the court house being one to proceed to sell at public sale to the highest bidder for ready money if required all said property or Such portion thereof as may be required and out of the proceeds of said Sale to pay all necessary expenses of attending said sale and also pay to the said Builford Cannon the said debt of two hundred and fifty dollars and forty six cents Interest &c. and also said Bank debt or whatever part or portion may remain unpaid at that time and the balance to return or pay over to said McKenzie but if the said Samuel A McKenzie shall well and truly pay and Satisfy said debt to said Builford Cannon and also pay and satisfy said debt in bank so as to release said Guilford Cannon from all or any liability for the sum without sale of said property as aforesaid before the aforesaid first day of October next then this obligation to be void and of none effect otherwise to remain in full force and virtue. In Witness whereof we have hereunto Set our names and affixed our Seals the date first above written.
