A deed of Trust from Saml A McKenzie to James Pursley for W Ballard land 1 negro.
This Indenture made & entered into this 14th day of December 1833 by between Samuel A. McKenzie of the first part & James Pursley of the second part and Washington Ballard of the third part all of the county of Roane & State of Tennessee. Witnesseth That Whereas the said Samuel A. McKinzie hath this day received of the said Washington Ballard two hundred & fifty four dollars & executed his bond unto the said Ballard to make & execute or cause to be made & executed unto the said Ballard his heirs &c a good & sufficient warranty deed in the fee simple to a certain tract or parcel of Land therein described on or before the twenty fifth day of December one thousand eight hundred & thirty six & the said McKinzie being desirous to secure the said Washington Ballard his heirs &c on the same payment of two hundred & fifty four dollars on deed to said Land by said 25th day of December 1836 & for & in consideration of the sum of ten dollars in hand paid by the said James Pursley the receipt whereof is hereby acknowledged the said Samuel A. McKinzie hath Bargained and sold and by these presents doth bargain and sell unto the said James Purselley a certain negro girl Named Palsey about fourteen years old.

To have and to hold said girl as belonging to him the said Purselley his heirs &c. For the purpose hereinafter mentioned and for no other use or purpose whatsoever viz. That in case the said Saml. A. McKenzie shall fail to make a good right to said Land according to his bond. That then and in that case it shall and may be lawful for the said James Purselley and hi is hereby authorised and required to proceed to sell said negro girl at publick sale to the highest bidder for ready money by giving Twenty days notice by advertisement or otherwise and out of the proceeds of said sale to pay all necessary expences of attending said sale. also to pay to the said Ballard the said sum of two hundred and fifty five dollars and the overpluss if any to return to the said McKinzie his heirs &c. But if the said McKinzie doth well and truly make and execute unto the said Ballard a good & sufficient right and title to said Land according his bond against said 25th Dec. 1836 Then this deed of Trust to be void and of none affect. Otherwise to remain in full force and virtue. Each of the parties covenant with the others faithfully to adhere to the covenants herein contained and the Trustee covenants well truly and faithfully to execute the Trust in him reposed. In witness whereof we have hereunto set our hands and affixed our seals the date first above written:
