This Indenture made This eleventh day of April one Thousand Eight hundred and twenty Seven between John Lambeth Senr. of the one part of the County of Davidson & State of North Carolina for the first part & Peter Owen of the second part of the County and State aforesaid & Samuel Lambeth of the third part. Witnesseth Whereas the sd. John Lambeth is Justly indebted to the said Samuel Lambeth in the sum of one hundred and Twenty Seven Dollars & twenty Cents due By note bearing date the 20th of August next & Whereas the Said Lambeth are honestly desirously to secure and save harmless the sd. Lambeth in the premises. Therefore this Indenture Witnesseth that the sd. Lambeth for and in consideration of the premises and the further sum of one Dollar to them in hand paid the receipt whereof is hereby acknowledged hath bargained Granted and sold & by these Presents doth bargain and sell unto the said Peter Owen his Heirs Executors Admrs. & assigns Two Tracts or parcels of Lands Situated lying and being in the County of Davidson & State aforesaid bounded by Moses Lambeth, Hargrave and others Containing Three hundred Acres More or less to have and to hold the aforesaid land & premises with all the appurtenances thereunto belonging to him his Heirs Executors & adminrs. and assigns in Trust and Confidence nevertheless and for uses intents and purposes herein after mentioned and no other that is to say if the aforesd. Lambeth shall well and truly satisfy and pay to the said Samuel Lambeth his heirs Exrs. Admrs. and assigns within this and the 20th of August 1827. The said note aforesaid and if sd. note is Setled by the time aforesd. then the above obligations to be void and of no effect but in case the said Lambeth should fail to pay and Satisfy to the sd. Lambeth the amount of the note aforesd. by the time or before mentioned then it shall and may be lawful for the sd. Peter Owen after advertising agreeable to Law Then he shall proceed to sell to the highest bidder as much of the before described Land & Premises as will Satisfy the amount of the Said note and interest and the expenses of proving and Registering this Deed as well as the expenses of tending the Sale of the aforesd. Land but if the aforesd. Lambeth shall well and truly satisfy and pay to said Lambeth by the time or before mentioned the amount before mentioned note then this indenture & every part thereof to be void and of no effect otherwise to remain in full force and virtue whereas I do hereunto set my hand & affix my seal the day & date above written.
