In the Name of God Amen. I Thomas Smith of Warren County and State of Georgia being in a low state of health but of perfect mind and memory Blessed be God for it and all other of his Benefits towards me, but know that it is appointed unto all men once to die, do this twentieth day of November in the year of our Lord Christ one thousand seven hundred and ninety six make & publish this my last will & testament in manner and form following that is to say

first I give and bequeath unto my dearly well beloved Mother Phebe Smith my Negro Boy named Robin to have and to hold as her property and to be at her disposal for her life and at her death the Boy to be sold and the money he sells for to be Equally divided Between James Smith son of Wilkins Smith and James Travis Son of John Travis to be delivered unto them by my Executors hereafter named at the age of twenty one years.

Item I give and bequeath unto John Travis my horse & saddle.

Item I give & bequeath unto my well beloved sister Mourning Hardin all my part of the dividing Estate still coming to me from my father Thomas Smith deceased.

Item I give unto James Smith son of Wilkins Smith my Colt.

Item I give & bequeath unto my beloved Mother Phebe Smith the Remainder of my present crop after all my just debts and funeral Expences is paid out of the same, and further I hereby make and ordain my worthy & well beloved friend John Travis Executor of this my last will & testament.

In Witness whereof I the said Thomas Smith have to this my last will & testament set my hand & seal the day & year first above written.

State of Georgia Warren County } Personally appeared before me Jones Kindrick & being duly sworn by the holy Avengelist of Almighty God deposeth and Saith that he saw the within named Thomas Smith sign his name and Acknowledge the same to be his hand and seal to the within will and testament and at the time of his so doing he was of sound mind and memory and in his presence and in the presence of the Other Absent Witness and at the Request of the said Thomas Smith deceasd they became a witness to the same. Sworn before me this 29th day of decembr 1797.
